The Epicweb.Optimizely.AIAssistant Service is available for free evaluation within the Optimizely UI. When used in production, there may be a license message displayed, or usage may be limited. Premium users receive priority access, email support, and additional configuration options. Users must comply with laws, refrain from unauthorized use or redistribution, and not reverse engineer the Service. The Provider retains ownership of the Service and may incorporate user feedback. The agreement can be terminated by either party, and the Provider disclaims warranties and limits liability. The agreement is governed by the laws of a specific jurisdiction. Any changes to the terms will be communicated, and users are considered independent contractors. By using the Service, users agree to these terms.
The Provider referred to in this agreement is Epicweb AB, a company registered in Sweden under registration number SE5561375618 and located in the City of Norrkoping, Sweden. Any references to "Provider" in this agreement shall be understood to mean Epicweb AB.
1.1 Evaluation Use: The Service is provided free of charge for evaluation purposes. During the evaluation period, You may access and use the Service to assess its suitability for your needs.
1.2 Production Use: If You choose to use the Service in a production environment without any license, a license message may be displayed by the Service. By continuing to use the Service in production, You agree to display the license message as required.
1.3 Premium Users: Premium users, as determined by Provider, are granted additional privileges and benefits. These may include priority access, email support, and enhanced configuration options. The specific features and benefits will be outlined in the premium user agreement.
2.1 Compliance: You shall comply with all applicable laws, regulations, and third-party rights while using the Service.
2.2 No Reverse Engineering: You shall not reverse engineer, decompile, or disassemble the Service or attempt to derive its source code, except to the extent expressly permitted by applicable law.
2.3 Unauthorized Use: You shall not use the Service for any unlawful or unauthorized purpose, including but not limited to transmitting any material that may infringe upon intellectual property rights or violate any privacy rights.
2.4 No Redistribution: You shall not distribute, sublicense, or transfer the Service or any part thereof to any third party without the prior written consent of the Provider.
3.1 Ownership: The Service, including any and all intellectual property rights, shall remain the exclusive property of the Provider.
3.2 Feedback: If You provide any feedback, suggestions, or ideas regarding the Service, You hereby grant the Provider a non-exclusive, perpetual, irrevocable, royalty-free license to use and incorporate such feedback into the Service or any other products or services.
4.1 Termination by User: You may terminate this agreement by discontinuing the use of the Service.
4.2 Termination by Provider: Provider reserves the right to terminate this agreement and suspend or terminate your access to the Service at any time, with or without cause or notice.
5.1 OpenAI Service Dependency: The Epicweb.Optimizely.AIAssistant Service within the Optimizely UI relies heavily on the OpenAI service for its functionality and performance. It is important to note that the quality, availability, and performance of the Service may be impacted by the performance and availability of the underlying OpenAI service.
5.2 Performance Limitations: The Provider acknowledges that there may be instances where the OpenAI service experiences downtime, latency, or other performance issues that could affect the functionality or responsiveness of the Epicweb.Optimizely.AIAssistant Service. While the Provider will make reasonable efforts to minimize any disruptions, the Provider cannot guarantee uninterrupted or error-free operation of the Service due to factors beyond its control.
5.3 No Liability for OpenAI Service Performance: The Provider shall not be held liable for any performance issues, interruptions, delays, or other problems arising from or related to the performance or availability of the OpenAI service. The User acknowledges that any such issues arising from the OpenAI service are beyond the Provider's control and agrees that the Provider shall not be responsible or accountable for any damages, losses, or liabilities incurred as a result.
By continuing to use the Epicweb.Optimizely.AIAssistant Service within the Optimizely UI, You acknowledge and accept that the Service's performance is subject to the performance and availability of the underlying OpenAI service, and You release the Provider from any liability or responsibility for any issues arising from the OpenAI service's performance.
THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTY, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THE PROVIDER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL THE PROVIDER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE AGGREGATE LIABILITY OF THE PROVIDER SHALL NOT EXCEED THE AMOUNT PAID, IF ANY, BY YOU FOR THE SERVICE.
7.1 Entire Agreement: This agreement constitutes the entire agreement between You and the Provider concerning the Service and supersedes all prior or contemporaneous communications and proposals, whether oral, written, or electronic.
7.2 Governing Law: This agreement shall be governed by and construed in accordance with the laws of Sweden. Any disputes arising out of or relating to this agreement shall be subject to the exclusive jurisdiction of the courts located within Sweden.
7.3 Severability: If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
7.4 Waiver: The failure of either party to enforce any right or provision of this agreement shall not be deemed a waiver of such right or provision.
7.5 Assignment: You may not assign or transfer any rights or obligations under this agreement without the prior written consent of the Provider. The Provider may freely assign or transfer its rights and obligations under this agreement.
7.6 Modifications: The Provider reserves the right to modify or update these terms of use at any time. Any changes will be effective upon posting the updated terms of use on the Provider's website or notifying You through other reasonable means. Your continued use of the Service after the changes indicates your acceptance of the modified terms.
7.7 Relationship of the Parties: Nothing in this agreement shall create a partnership, joint venture, agency, or employment relationship between You and the Provider. You agree that you are an independent contractor and shall not represent yourself as an agent or representative of the Provider.
By using Epicweb.Optimizely.AIAssistant Service within the Optimizely UI, You acknowledge that you have read, understood, and agreed to be bound by these terms of use. If you do not agree with any part of these terms, you should not use the Service.
